BIOGRAPHY

Mr. AbdulAziz AlBisher is a partner with Meysan, experienced with more than twenty-five years of hands-on trial and appellate experience in Kuwait. Licensed to appear before the Constitution Court and Court of Cassation, Mr. AlBisher is specialized in meeting the extraneous legal demands of multinational companies, restructuring legal teams, and mediating complex disputes.

Mr. AlBisher’s expertise revolves around commercial and capital market disputes, taking several securities cases to trial and prevailing. In particular, Mr. AlBisher represented major financial brokerage firms and financial and real estate funds against the Capital Markets Authority, other regulators and private investors.

Over the last five years, Mr. AlBisher amassed the trust of government-owned oil and gas companies. Representing two of the biggest downstream K-companies, Mr. AlBisher navigates, on a daily basis, sophisticated contracting/construction disputes, compliance, employment and union related matters and overarching corporate structure advice from a legal perspective.

Mr. AlBisher was a lecturer and a member of the legal advisory team of the Public Authority for Housing Welfare for Sabah Al-Ahmad Residential City, the urban core of Kuwait’s southern sub-region.

EXPERIENCE

Kuwait-based Bayan Holding Company before the Court of Cassation in the Kingdom of Bahrain, and before the Bahrain Chamber for Dispute Resolution (BCDR) in a USD 100 million+ dispute.

Bayan Holding Company and the Kuwait Finance and Investment Company (KFIC) in tax assessment disputes with the Ministry of Finance since 2015.

First Dubai Real Estate Development Company (KSC) in relation to long-term loan agreements and insurance transfer agreements for the purpose of financing the Sky Gardens Residential Tower Project in the Dubai International Financial Center (DIFC) with Abu Dhabi Commercial Bank at values exceeding USD 90 million.

First Dubai Real Estate Development Company (KSC) in relation to agreements with Emirates Bank International in USD 60m+ claims.

KFIC Financial Brokerage Company (KSC) during the negotiations, settlement agreement drafting and initial legal representation with respect to a receivable amounting to USD 12 million in 2011. The receivable amount was amicably and fully collected by KFIC Financial Brokerage Company.

Kuwait Finance and Investment Company (KFIC) in attaching the assets of a debtor-group resulting in successful enforcement proceedings and collections in the amount of approximately USD 30 million.

Industrial Bank of Kuwait (IBK) and the Kuwait Industrial Projects Company (KSC), a sister company of IBK, to successfully remove a judicial receiver of an affiliate company, the Industrial and Financial Investments Company in December 2021.

Five creditor companies to negotiate and settle a combined debt of USD 220 million pursuant to the newly-enacted Financial Stability Law (2/2009), which governed the debt-restructuring arrangements following the 2008 financial crisis.

The heirs of a prominent member of the Kuwaiti ruling family to incorporate and structure their asset-management companies, which finally held a total asset value of more than USD 100 million in 2008.

First Saudi Real Estate Development Holding Company in successfully claiming and collecting about USD 1.4 million.

Kuwait National Petroleum Company (KNPC) in its defense of financial claims exceeding USD 230 million against main contractors performing megaprojects for KNPC.

Kuwait National Petroleum Company (KNPC) in criminal proceedings following a referral by a Kuwait National Assembly Parliamentary Inquiry Committee with respect to public fund embezzlement suspicions, which ultimately resulted in vindicating KNPC’s position in March 2022.

Tijara & Real Estate Investment Company (KSC), in relation to drafting and preparing an agreement to provide consulting services for the design, implementation and development of a large real estate project in the French city of Divonne-les-Bains.

Kuwait Finance and Investment Company (KFIC) in relation to the management of e-trading in light of the previously executed trading agreements between KFIC and its clients.

KFIC Financial Brokerage Company (KSC) in executing a financial brokerage agreement with the Bahraini Arqaam Investment Company.

A Bahrain Import Investment Company subsidiary to acquire shares in First Bahrain Real Estate Development Company.

Aviation Lease and Finance Company (ALAFCO) in relation to a lease agreement with Kuwait Airways for (3) A320 aircrafts with the General Directorate of Civil Aviation.
