Meysan’s legal team, led by Partner Waleed Al-Tattan and Senior Counsel Tarek Diab, achieved a significant court victory on behalf of one of Saudi Arabia’s largest banks. The team successfully obtained two rulings from the Kuwaiti courts enforcing execution orders issued by a Saudi enforcement judge against two Kuwaiti guarantors, with a combined value exceeding SAR 127 million.
This judicial success represents a notable legal precedent in Kuwait, as it involved an unconventional application of the rules governing the enforcement of foreign judgments and orders. Unlike standard foreign court judgments, execution orders differ in their nature and legal requirements and have traditionally been treated differently by the Kuwaiti legal system.
The rulings are significant in affirming the flexibility of the Kuwaiti judiciary to recognize and give effect to foreign legal instruments such as execution orders. These instruments are typically simpler and faster than full court judgments, yet they often face more restrictive procedural treatment across many jurisdictions.
The Meysan team expressed pride in this achievement, which reflects both meticulous legal work and deep comparative legal analysis.
They emphasized that this success is not only a major step forward for the client, but also paves the way for future developments in the enforcement of foreign orders, particularly in light of growing commercial and judicial cooperation among Gulf states.
